Nepal, the sole country in the Indian subcontinent to legalize same-sex unions, recently marked a historic moment by officially recognizing the marriage of a queer couple. This landmark decision follows an interim order by the Supreme Court in June, permitting the registration of same-sex marriages. Maya Gurung, a 35-year-old transgender woman, and Surendra Pandey, a 27-year-old cisgender male, who have been together for nearly a decade, sought legal recognition of their union, culminating in the formal registration of their marriage in the Lamjung district of western Nepal.

Same-sex marriage is a dynamic legal and social issue resonating across South, Southeast, and East Asia, with a median of 49% of adults expressing at least some level of support for legalizing same-sex marriage, while 43% opposing it.

In a long-awaited decision, the Supreme Court unanimously ruled against legalizing same-sex marriage. The apex court's judgment declares that the right to marriage is not considered a fundamental one. It underscores its inability to alter the provisions of the Special Marriage Act or reinterpret its language, all while emphasizing that homosexuality extends beyond urban or elite contexts.
