The fourth anniversary of the Article 370 abrogation in Jammu and Kashmir that falls on August 5 showcases a mix of political celebrations and tensions in the region.
The BJP has arranged celebratory events across Jammu and Kashmir. However, the Peoples Democratic Party (PDP), under the leadership of Mehbooba Mufti, has raised concerns, alleging that the authorities have detained some of their leaders. The PDP had requested permission from the Srinagar administration to conduct an event at Sher-e-Kashmir Park near their headquarters, aiming to host a seminar or discussion with the public and like-minded regional parties. Regrettably, permission for the event was denied. These actions add to the complexity of the issue and highlight the differing perspectives surrounding the constitutional change.
Expressing her reservations about the detentions, Mehbooba Mufti took to Twitter and posted a video showing a PDP leader being taken away in a police vehicle on the eve of August 5.
SUSPENSION OF AMARNATH YATRA
In addition to these political developments, the Amarnath Yatra, a significant pilgrimage in the region, was temporarily suspended for a day from the Jammu base camp due to security concerns arising from the anniversary of the Article 370 abrogation and Article 35A.
THE RECALL
On August 5, 2019, the Government revoked Article 370 and Article 35A, which granted special privileges to the state of Jammu and Kashmir. As a result, the state was reorganized into two separate Union Territories—Jammu and Kashmir (with a legislature) and Ladakh.
In the legal arena, the Supreme Court of India commenced hearings on August 2, 2023, regarding a petition seeking the repeal of the Government of India’s order abrogating Article 370. The case, titled “In Re: Article 370 of the Constitution,” has garnered significant attention, with over 52 attorneys representing the petitioners seeking the repeal. On the other side, there are more than 38 attorneys representing the respondents who support the abrogation. Additionally, there are 64 named intervenors, most of whom are advocates, and 34 applicants representing themselves in the case.
